During my career I have found instances of inequity. Some strategies that would be helpful to confront these inequities in my current role would be to remind the instances using Title IX.
Although this is hard for me to admit. I do feel that I get discriminated against because of my age in the workforce. I have been passed by on positions that I see “younger people get hired for. I have the credentials for positions and have witnessed those that are millennials get hired because the “LOOK YOUTHFUL” and they can connect with a “target audience” but to me that is unfair to assume that I would not be able to do that. I also “look younger” than I actually and am able to connect with the younger population. My daughter is 20-years-old and I actually teach students who are her age and some who were her former classmates, or on her soccer team or in her dance school.

I think some ways strategies I could use to confront these inequities is to remind the hiring folks or my supervisors about the Title IX “Civil Rights Act of 1964 – that prohibits discrimination on the basis of race, color, national origin in all programs and activities that receive federally funded assistance. One women that I admire in Banks, J.A. & Banks, C.A. (2016) is Patsy T. Mink who is considered the “Mother of Title IX” who helped launch the Amendment of Higher Education Act – The “Patsy T. Mink Equal Opportunity Act”. Patsy was a pioneer into getting women to be treated equally. It is important for women to be treated equally especially in the work force and age discrimination is not fair for those who have experience, education and sweat equity. Making sure that women and workers of all ages are not discriminated against is important both young and old(er) however, experience should count and using “younger people” to be the face of higher education is unfair to older populations.

In addition, I would not want my students to feel like they could not be hired because of their age as well. We need to find a balance where older and younger generations can have equal access in the workforce.

OCR also enforces Section 1557 of the Patient Protection and Affordable Care Act which provides that an individual shall not be excluded from participation in, be denied the benefits of, or be subjected to discrimination including on the grounds prohibited under, the Age Discrimination Act of 1975 (age) under any health program or activity, any part of which is receiving federal financial assistance, or under any program or activity that is administered by an Executive Agency or any entity established under Title I of the Affordable Care Act or its amendments.

OCR can only investigate health programs and activities that receive federal financial assistance from the HHS or are administered by HHS or any entity established under Title I of the Affordable Care Act or its amendments.
